Digital Service Purchase Terms of Agreement

Agata Business Services

These terms apply to all digital products and digital services sold on www.agatabusiness.com, including but not limited to downloadable files (PDFs), online materials, digital marketing services, SEO services, website services, and digital consultancy.

By purchasing, the customer confirms acceptance of these terms.

1. Payment and Refund Policy

All payments are processed securely via providers such as Stripe or PayPal using encrypted (SSL) technology.

All products and services sold are digital and intangible.
Once access to a digital service or content has been granted, the service is considered to have started.

No Refund Policy

Due to the nature of digital services, all purchases are non-refundable and non-exchangeable once access, delivery, or work has begun.

This includes but is not limited to:

• SEO services

• Website design

• Digital downloads

• Consultancy

• Subscriptions

• Discounted services

• One-time purchases

This policy applies whether the service was purchased at full price or with a discount.

2. Legal Basis for Non-Refundable Digital Services

This policy is fully supported by UK Consumer Law.

Consumer Contracts Regulations 2013 (UK)

Regulation 37

“The right to cancel is lost once the performance of a service has begun with the consumer’s express consent and acknowledgement that the right to cancel will be lost.”

When a customer purchases and gains access to digital services or downloads from Agata Business Services, they explicitly agree that the service begins immediately.

Digital Content Exception — Regulation 38

“The right to cancel does not apply to digital content which is not supplied on a tangible medium if performance has begun with the consumer’s express consent.”

This applies to:

• PDFs

• SEO work

• Digital design

• Online resources

• Consultancy

• Platform-based digital services

Once delivery, access, or work begins, the purchase becomes legally non-refundable.

3. Discounts and Promotional Purchases

All discounted services, promotional offers, and coupon-based purchases are final and non-refundable.

This is lawful under:
Consumer Rights Act 2015
Section 34–36, which allows traders to define pricing and refund conditions for digital services as long as terms are clearly disclosed before purchase.

4. Delivery of Digital Services

If you do not receive access to your digital product or service, contact:

• Payment confirmation

• Email used for purchase

Your access will be delivered without delay.

5. Right to Amend

Agata Business Services reserves the right to update:

• Prices

• Services

• Terms

• Packages

• Specifications

at any time without prior notice.

6. Governing Law & Jurisdiction

This agreement is governed by the laws of England and Wales.

Any dispute shall be resolved under the jurisdiction of the courts of England and Wales and conducted in the English language.

7. Legal Notice

All purchases constitute acceptance of these terms.
By purchasing, the client agrees that the digital service begins immediately and therefore waives the statutory right to cancellation under UK consumer law.
