CLASSIC WEBSITE DESIGN FOR PAINTERS
PRODUCT-SPECIFIC TERMS & SERVICE AGREEMENT
WIX SOLUTIONS
These Product-Specific Terms apply to the purchase of the Classic Website Design for Painters service supplied by WIX SOLUTIONS.
These Terms operate together with the WIX SOLUTIONS Digital Services Terms & Conditions and All Services Agreement available on the WIX SOLUTIONS website.
Where these Product-Specific Terms expressly differ from the general WIX SOLUTIONS terms, these Product-Specific Terms shall take priority in relation to the Classic Website Design for Painters service only.
1. BUSINESS-TO-BUSINESS SERVICE ONLY
This service is supplied strictly on a business-to-business (B2B) basis.
It is intended for painters, decorators, painting companies, sole traders, self-employed professionals and other businesses purchasing the website for business purposes.
By purchasing this service, the Client confirms that:
they are acting wholly or mainly in the course of their trade, business, craft or profession;
the website is being purchased for business purposes;
they are not purchasing as a consumer; and
if purchasing on behalf of a company or other organisation, they have authority to enter into this Agreement on its behalf.
WIX SOLUTIONS does not accept consumer purchases for this service.
2. ACCEPTANCE OF THIS AGREEMENT
This Agreement is entered into electronically.
Before purchasing the service, the Client must be given access to these Product-Specific Terms and the applicable WIX SOLUTIONS General Service Terms.
By:
ticking the required acceptance box at checkout; and
completing payment,
the Client confirms that they have read, understood and agreed to these Terms.
The completed online purchase constitutes acceptance of the contract.
No separate paper agreement is required unless WIX SOLUTIONS specifically requests one.
3. SERVICE PURCHASE PRICE
The Client must pay the full advertised project price in advance.
No work will commence until WIX SOLUTIONS has received cleared payment in full.
The purchase price covers only the features and quantities described in the product listing and this Agreement.
Wix Premium or Business plans, domain registration, business email services, paid third-party applications and other recurring third-party costs are not included, unless expressly stated otherwise on the product page.
4. PROJECT START
The project will normally enter production within 24 hours after full cleared payment has been received.
For the purposes of this Agreement, the project is considered to have started when WIX SOLUTIONS begins any project-specific work, including:
reviewing the Client's information;
planning the website;
preparing design concepts;
preparing Home page mockups;
researching or preparing content;
selecting or preparing imagery;
creating website structure;
creating CMS collections;
performing SEO research or setup;
writing website content; or
otherwise commencing work specifically for the Client.
The 24-hour period relates to commencement of work and does not mean that the complete website will be delivered within 24 hours.
5. PAYMENT AND REFUNDS
This is an economical, fixed-scope professional website project.
Before the project starts
If the Client requests cancellation before WIX SOLUTIONS has commenced project-specific work, any refund will be dealt with in accordance with the applicable WIX SOLUTIONS General Service Terms.
After the project starts
Once work on the project has commenced, the project price is non-refundable.
This applies if the Client:
changes their mind;
decides they no longer require a website;
does not provide the requested information;
fails to continue communicating with WIX SOLUTIONS;
chooses another designer;
changes their business plans; or
decides not to use the completed website.
The Client acknowledges that payment reserves WIX SOLUTIONS' professional time and that significant project-specific work may begin immediately.
Nothing in this clause excludes any liability or remedy that cannot lawfully be excluded under the laws of England and Wales.
6. ECONOMICAL FIXED-SCOPE PROJECT
The Classic Website Design for Painters service is an economical, fixed-scope website package.
It is not a fully bespoke website-development contract involving unlimited consultation, repeated design changes or revision rounds.
The lower project price is possible because:
the project follows an established professional structure;
the scope and content quantities are predefined;
communication is conducted online;
the Client chooses from three initial Home page concepts; and
revision rounds are not included in the standard price.
Work outside the agreed scope may be quoted separately.
7. THREE HOME PAGE MOCKUPS
WIX SOLUTIONS will initially prepare 3 Home page design mockups.
The Client selects one of the three proposed designs.
The selected design becomes the visual direction for the complete website.
The three mockups are design concepts only and do not constitute three separate complete websites.
8. NO DESIGN REVISION ROUNDS INCLUDED
Because this is an economical fixed-scope package, design revision rounds are not included in the purchase price.
Once the Client selects one of the three Home page mockups, WIX SOLUTIONS will develop the website based on that selected design direction.
Requests to substantially:
redesign the selected layout;
replace the chosen design;
restructure the website;
change the visual direction;
introduce additional functionality;
add additional pages;
add additional services or projects; or
undertake other work beyond the purchased package
will constitute additional work and may be quoted separately.
This does not prevent WIX SOLUTIONS from correcting an error made by WIX SOLUTIONS where the website does not correspond with the information supplied by the Client.
9. WEBSITE STRUCTURE
The Classic Website may include the following structure as stated in the product description:
Home
About
Services
Projects / Portfolio
Gallery
Blog
FAQ
Contact
Privacy / Data Protection information
Cookie Policy
The exact layout and presentation are determined by the selected design and the requirements of the Client's business.
10. SERVICES – UP TO 6
The package includes creation and initial population of up to 6 service entries/pages.
Examples may include:
Interior Painting
Exterior Painting
Residential Decorating
Commercial Decorating
Wallpapering
Woodwork Painting & Finishing
Where appropriate, services may be created using Wix CMS and dynamic pages.
The Client provides accurate information about the services they actually offer.
WIX SOLUTIONS creates and edits the professional website copy based on that information.
Additional services beyond the included six are not included and may be quoted separately.
11. PROJECTS / PORTFOLIO – UP TO 6
The package includes setup and initial publication of up to 6 portfolio projects.
The Client should provide:
project information;
project location where appropriate;
services performed; and
photographs where available.
WIX SOLUTIONS may create professional descriptions based on the information provided.
The Client is responsible for ensuring that projects represented as their completed work were genuinely completed by them or that they otherwise have the legal right to represent those projects.
Additional portfolio projects can be added for an additional charge.
12. GALLERY – UP TO 30 IMAGES
The package includes placement of up to 30 images.
Where possible, the Client should supply photographs of their own work.
The Client confirms that they have permission to use any images supplied to WIX SOLUTIONS.
If sufficient suitable images are not supplied, WIX SOLUTIONS may use appropriate:
licensed stock images; and/or
AI-generated images.
Stock or AI imagery is used for illustrative purposes and will not knowingly be presented as genuine completed Client projects where this would be misleading.
13. PROFESSIONAL CONTENT WRITING
Professional website content writing and editing are included within the agreed package.
The Client does not need to prepare finished website copy.
The Client must instead provide accurate factual information about their business.
Based on that information, WIX SOLUTIONS may create:
headlines;
marketing copy;
About content;
service descriptions;
project descriptions;
calls to action;
FAQ content;
contact content;
local service-area content;
supporting SEO copy; and
other website text required for the agreed project.
The Client remains responsible for the accuracy of factual claims about their own business.
14. BLOG
The initial website package includes 3 blog articles written or prepared by WIX SOLUTIONS.
The subject matter will be relevant to the Client's painting, decorating or related services.
Additional blog articles are not included unless separately purchased or agreed.
15. SEO SETUP
Professional initial SEO setup is included in the package.
Depending on the website structure, this may include:
SEO page titles;
meta descriptions;
search-friendly URLs;
heading structure;
image alt text;
internal linking;
service-page SEO;
project-page SEO;
local service-area optimisation;
Blog SEO setup;
Wix SEO configuration;
sitemap configuration; and
search-engine indexing configuration.
SEO setup does not constitute an ongoing SEO campaign.
WIX SOLUTIONS does not guarantee:
first-page Google rankings;
any specific ranking position;
website traffic;
enquiries;
leads;
sales; or
any particular commercial result.
16. CONTACT FORM AND COOKIE CONSENT
The website will include the applicable contact-form functionality stated in the product description.
A cookie consent solution will also be configured where included and appropriate to the website setup.
The Client is responsible for informing WIX SOLUTIONS accurately about how their business collects and uses personal information.
17. WEBSITE POLICIES AND REGULATORY CONTENT
Where included in the package, WIX SOLUTIONS may prepare website content including:
Privacy / Data Protection information; and
Cookie Policy wording.
Such content is prepared on the basis of information supplied by the Client and the known configuration of the website.
WIX SOLUTIONS provides website-development and content services and is not acting as the Client's solicitor or regulated legal adviser.
The Client remains responsible for ensuring that their business and website comply with all laws and regulatory requirements applicable to their particular business.
18. CLIENT INFORMATION AND COOPERATION
The Client must provide information reasonably required for the project, which may include:
business name;
contact information;
services;
service areas;
business background;
experience and qualifications;
branding and logo;
photographs;
project information;
testimonials;
social-media accounts;
business policies; and
other information reasonably required to create the website.
The Client must provide accurate and lawful information.
Delays by the Client in supplying required information may delay the project.
19. COMMUNICATION
Communication for this economical project is conducted primarily online by email.
Meetings, Zoom calls, telephone consultations or other consultation sessions are not included unless separately agreed.
The primary project email address is:
20. WIX WEBSITE AND THIRD-PARTY COSTS
The Client is responsible for purchasing and maintaining any required:
Wix Premium or Business plan;
domain;
business email service;
paid application;
third-party subscription; or
external service
unless specifically stated as included in the product purchase.
WIX SOLUTIONS does not control future Wix or third-party pricing, functionality, availability or platform changes.
21. WEBSITE OWNERSHIP – SPECIAL TERM FOR THIS PRODUCT
This clause specifically varies the standard WIX SOLUTIONS ownership arrangement for the Classic Website Design for Painters product only.
Once:
the Client has paid the complete project price;
WIX SOLUTIONS has completed the agreed project; and
all charges for any separately authorised additional work have been paid,
WIX SOLUTIONS will transfer ownership of the completed Wix website to the Client's Wix account at no additional ownership or transfer charge.
The Client will therefore become the Wix site owner and may manage, edit and operate the completed website.
This special ownership arrangement replaces any general WIX SOLUTIONS term that would otherwise provide only co-ownership or a standard usage licence, but only in relation to ownership of the completed Wix website supplied under this particular product.
22. WHAT WEBSITE OWNERSHIP DOES NOT INCLUDE
Transfer of the Wix website does not transfer ownership of:
the Wix platform;
Wix software;
Wix applications;
third-party software;
third-party plugins;
externally licensed fonts;
third-party stock images;
third-party intellectual property;
WIX SOLUTIONS' general templates;
reusable code libraries;
design systems;
development processes;
know-how; or
other pre-existing WIX SOLUTIONS intellectual property.
Those items remain subject to their existing ownership and licensing arrangements.
23. WIX SOLUTIONS DESIGNER CREDIT – CONDITION OF FREE OWNERSHIP TRANSFER
The Client receives transfer of ownership of the completed Wix website without an additional ownership or transfer fee in exchange for retaining the WIX SOLUTIONS designer credit on the website.
The website footer will contain a visible credit substantially in the following form:
Website Design by WIX SOLUTIONS
with a working hyperlink to:
https://www.wixsolutions.co.uk/
The exact presentation may be adapted to fit the website design, provided that the WIX SOLUTIONS name and link remain reasonably visible and functional.
24. DESIGNER CREDIT MUST REMAIN
The Client agrees that the WIX SOLUTIONS designer credit forms part of the consideration for the ownership arrangement offered under this economical package.
The Client therefore agrees not to:
remove the credit;
conceal the credit;
deliberately make the credit unreadable;
remove or disable the hyperlink;
alter the credit so that WIX SOLUTIONS is no longer identified as the website designer; or
instruct another person to remove it,
without prior written agreement from WIX SOLUTIONS.
The credit should remain for as long as the website designed by WIX SOLUTIONS, or a substantially derived version of that website, remains in use.
25. OPTIONAL REMOVAL OF DESIGNER CREDIT
If the Client later wishes to remove the WIX SOLUTIONS designer credit, they may contact WIX SOLUTIONS.
WIX SOLUTIONS may agree to removal subject to a separately agreed designer-credit removal/buyout fee.
Until written agreement has been reached, the existing footer-credit obligation continues.
26. CLIENT CHANGES AFTER OWNERSHIP TRANSFER
After ownership has been transferred, the Client may operate and edit their website.
WIX SOLUTIONS is not responsible for problems caused by changes made after handover by:
the Client;
the Client's employees;
another web designer;
another agency;
another developer; or
another third party.
Future website maintenance, redesign or support is not included unless separately purchased.
27. PORTFOLIO RIGHTS
WIX SOLUTIONS may display reasonable non-confidential elements of the completed project as examples of its professional work.
This may include:
screenshots;
website links;
project descriptions; and
references to the website
within the WIX SOLUTIONS portfolio, website, social-media channels and marketing materials.
Confidential information that is not publicly available will not intentionally be disclosed.
28. CLIENT-SUPPLIED MATERIALS
The Client retains ownership of original materials supplied by them.
By supplying content, images, logos or other materials, the Client gives WIX SOLUTIONS permission to use and adapt those materials as reasonably necessary to complete the website.
The Client confirms that they have the rights and permissions necessary to provide those materials.
29. THIRD-PARTY PLATFORMS
The website depends upon Wix and may depend upon other third-party providers.
WIX SOLUTIONS cannot guarantee the uninterrupted future availability of third-party platforms, applications or functions.
WIX SOLUTIONS is not responsible for problems caused solely by:
Wix outages;
third-party outages;
changes made by Wix;
discontinued third-party applications;
future third-party subscription changes; or
matters outside WIX SOLUTIONS' reasonable control.
30. COMPLETION AND HANDOVER
When WIX SOLUTIONS considers that the purchased project scope has been completed, the website will be prepared for handover or transfer to the Client.
Completion is assessed against:
the purchased product description;
the selected Home page mockup;
these Product-Specific Terms; and
any additional written work expressly agreed between the parties.
A request for additional work does not prevent the original agreed project from being regarded as completed.
31. LIABILITY
The limitation-of-liability provisions contained within the WIX SOLUTIONS General Service Terms continue to apply to this project.
Nothing in this Agreement excludes or limits liability where exclusion or limitation would be unlawful.
32. GOVERNING LAW AND JURISDICTION
This Agreement and any dispute or claim arising from it shall be governed by the laws of England and Wales.
The parties agree that the courts of England and Wales shall have jurisdiction, subject to any mandatory legal provisions that apply.
33. RELATIONSHIP WITH GENERAL WIX SOLUTIONS TERMS
The Client acknowledges that this Product-Specific Agreement must be read together with the general WIX SOLUTIONS:
Digital Services Terms & Conditions;
All Services Agreement;
applicable Privacy Policy; and
applicable website policies.
Those general terms continue to apply except where this document expressly creates a different rule for the Classic Website Design for Painters service.
In particular, the special ownership provisions contained in Sections 21–25 of this Agreement take priority over any general WIX SOLUTIONS ownership/co-ownership provision for this project.
34. FINAL CLIENT ACKNOWLEDGEMENT
By ticking the acceptance box and purchasing the Classic Website Design for Painters service, the Client expressly confirms that:
the purchase is B2B only;
full payment is made before work begins;
the project normally enters production within 24 hours after payment;
once project-specific work has started, the project is non-refundable for change of mind or Client cancellation;
the service is an economical fixed-scope project;
3 Home page mockups are provided;
the Client selects one mockup;
design revision rounds are not included;
up to 6 services are included;
up to 6 initial portfolio projects are included;
up to 30 gallery images are included;
3 initial blog articles are included;
professional content writing and SEO setup are included as described;
Wix plan, domain and third-party charges are separate unless expressly stated otherwise;
the completed Wix website will be transferred to the Client as owner at no additional ownership-transfer charge after completion;
the Client agrees in exchange to retain the visible WIX SOLUTIONS designer credit and working website link in the footer; and
these Product-Specific Terms and the applicable WIX SOLUTIONS General Service Terms together form the contract.
Purchase and electronic acceptance create a binding B2B service agreement.
